An H1B application is a petition filed by an employer on behalf of a foreign national to the United States Citizenship and Immigration Services (USCIS) for temporary employment in a specialty occupation. The employer must demonstrate that the foreign national has the necessary qualifications and experience for the job. The employer must also prove that the wages and working conditions meet the prevailing industry standards. An approved H1B petition allows the foreign national to work in the United States for up to three years and can be extended for a maximum of six years.
The H1B visa is a nonimmigrant visa that permits employers in the United States to hire foreign workers in specialty occupations. Employers must file an application petition with U.S. Citizenship and Immigration Services (USCIS) to obtain permission to employ a foreign worker in the U.S. The application petition is commonly referred to as an H1B application or an H1B petition. The application includes the employer’s commitment to pay the foreign worker their regular salary, as well as the details of the job duties and responsibilities given to the worker.
